Terms and Conditions

These Terms and Conditions ("Terms") govern the use of motorcycleholiday.com (the "Site") and the services we provide through it (together, the "Service"). By using the Service you agree to these Terms.

The Site and Service are operated by Catnach Ltd ("MCH", "we", "us", "our"), a company registered in England and Wales under company number 15886326, contactable at ride@motorcycleholiday.com.

These Terms are in two parts:

By using the Service as a Rider, Parts A, B and D apply to you. By using the Service as an Operator, Parts A, C and D apply to you (and, where signed, the separate Operator Agreement).


Part A — General Terms

MCH is a marketplace and directory. We connect Riders with Operators so Riders can discover and enquire about Tours. When a Rider clicks through from the Site to an Operator's own website or contacts an Operator through us, any resulting booking, contract, payment or Tour is solely between the Rider and the Operator.

MCH is not a tour operator, travel agent, travel organiser, package organiser, or retailer of travel services. MCH does not sell, organise, operate, supervise, deliver or insure any Tour.

3. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. Where changes are material, we will give reasonable notice through the Site or by email. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not accept them, stop using the Service.

4. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm you have the legal capacity to enter these Terms.

6. Accounts

If you create an account, you are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorised use.

7. Intellectual property in the Site

All rights in the Site, the MCH name, logos, branding, software, design and content (excluding Operator Content) belong to MCH or our licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Site as permitted by these Terms. No other rights are granted.


Part B — Rider Terms

8. No responsibility for Tours or Operators

This is the most important thing to understand as a Rider. MCH takes no responsibility for Tours or Operators. Specifically:

We try to keep Listings accurate but rely on Operators for the information shown. Prices, availability, routes, dates, inclusions and other details may change at any time. Always confirm details directly with the Operator before booking or travelling.

The Service is not a substitute for your own judgement. If in doubt, do not ride.

12. Newsletter and communications

You can subscribe to our newsletter through the Site. You can unsubscribe at any time via the link in any email or by contacting us. Service messages (for example, responses to enquiries) are not marketing and may continue regardless of marketing preferences.

13. Rider liability (to the extent permitted by law)

Nothing in these Terms limits or excludes:

If something goes wrong with a Tour, please contact the Operator first — they provide the Tour and are responsible for it. If you believe MCH has itself acted wrongly (for example, in how we handled your personal data or an enquiry), contact us at ride@motorcycleholiday.com and we will respond within a reasonable time.


Part C — Operator Terms

15. Relationship to the Operator Agreement

Operators use the Service under these Terms and a separate Operator Agreement. Where these Terms conflict with the Operator Agreement, the Operator Agreement prevails for that Operator.

By listing Tours on the Service, the Operator warrants and undertakes on a continuing basis that:

Operators access the Service via a secure login. The Operator is responsible for:

Operators may upload and manage Listings, including text, photos, videos, pricing, availability, routes, dates, inclusions and other details. The Operator is responsible for keeping Listings accurate and updated.

We may, at our discretion:

19. Content licence to MCH

The Operator grants MCH a worldwide, non-exclusive, royalty-free, sub-licensable, transferable licence to use, host, store, copy, adapt, modify, translate, display, publish and distribute any Content the Operator provides (including photos, videos, logos, text, itineraries and trade marks) for any purpose connected to operating, marketing and promoting MCH and the Tours, including:

This licence continues for the duration of the Operator's relationship with MCH and for a reasonable tail period of up to 24 months after termination to allow already-deployed marketing and advertising to be wound down. Attribution to the Operator is not required but will be given where reasonably practicable.

The Operator warrants that it owns or has secured all rights (including third-party model releases and photographer consents) necessary to grant this licence, and that the Content does not infringe third-party rights.

20. Price parity

The Operator agrees that Tours listed on the Service will not be offered at a lower headline price on the Operator's own website, app or direct sales channels than on MCH, with the following carve-outs:

  1. Short-duration promotions — the Operator may run a promotion of less than 30 days, at a lower price on its own channels, no more than three times per calendar year per Tour, without breaching this clause.
  2. Loyalty programmes — discounts, credits or rewards offered as part of a bona fide loyalty programme to existing direct customers are not covered by this clause.
  3. Closed-group / private offers — genuinely private offers (e.g. corporate bookings, group bookings negotiated individually, member-only rates not publicly advertised) are not covered by this clause.
  4. Third-party channels — this clause applies only to the Operator's own direct channels. It does not restrict the prices the Operator offers to or through other marketplaces, OTAs or resellers.

This clause applies only to the headline price of the same Tour offered with materially the same inclusions, dates and conditions. Packages with genuinely different inclusions or dates are out of scope.

If the Operator breaches this clause, MCH may (without limiting any other remedy) suspend Listings, require price correction, or terminate the Operator's access.

21. Fees and payments

At the date of these Terms, MCH does not charge Operators for Listings and does not process Rider bookings or payments. The Service is currently a discovery and referral channel that drives clickouts and enquiries.

MCH reserves the right to introduce commission, listing fees, booking-handling fees or other charges in the future. Any such fees will be set out in the Operator Agreement or a separate variation, and MCH will give Operators reasonable notice before they take effect.

22. Operator data and privacy

23. Confidentiality

Each party will keep confidential any non-public information received from the other that is marked or reasonably identifiable as confidential (including commercial terms, performance data and product roadmaps), and only use it for the purpose of performing under these Terms.

24. Indemnity from Operator

The Operator will indemnify and hold harmless MCH, its officers, employees and agents against any and all losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or connected with:

25. Suspension and termination

MCH may suspend or terminate an Operator's access to the Service at any time:

An Operator may terminate by giving notice in accordance with the Operator Agreement (or, in the absence of an Operator Agreement, by written notice to ride@motorcycleholiday.com).

On termination, the Operator's Listings will be removed within a reasonable period. The content licence in clause 19 continues for the tail period set out there. Accrued rights and obligations survive termination.

26. Operator liability (between MCH and Operators only)

This clause applies only as between MCH and Operators, not between MCH and Riders, and not between Operators and Riders.

Nothing in these Terms limits either party's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law. Subject to that, to the maximum extent permitted by law:


Part D — Legal Terms

27. Third-party rights

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, except that MCH group companies may enforce terms that benefit them.

28. Assignment

You may not assign, transfer or sub-contract any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to any member of our corporate group or to a successor in connection with a merger, sale or reorganisation.

29. Force majeure

Neither party is liable for delay or failure to perform caused by events outside its reasonable control, including natural disasters, war, terrorism, civil unrest, industrial action, government action, pandemics, or failure of utilities or communications networks. Obligations to pay money are not excused.

30. No partnership

Nothing in these Terms creates any partnership, joint venture, agency, franchise, employment or fiduciary relationship between the parties.

31. Severability

If any part of these Terms is found to be unenforceable, the rest continues in force. The unenforceable part will be read down to the minimum extent necessary to be valid.

32. No waiver

A failure or delay by either party to exercise any right or remedy is not a waiver of it.

33. Entire agreement

These Terms and (for Operators) the Operator Agreement, together with the Privacy Policy and Cookie Policy, make up the entire agreement between you and MCH and replace any prior agreement or understanding on the same subject. You confirm you have not relied on any statement or representation not set out in these documents.

34. Notices

Notices to MCH should be sent to ride@motorcycleholiday.com. Notices to you will be sent to the email address on your account or, for Riders without an account, to any contact email you have used to interact with the Service.

35. Governing law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.

Riders who are consumers resident in the UK, EU or EEA retain the benefit of any mandatory consumer protection rules of the country in which they are habitually resident. Those rules prevail over this clause to the extent they are more favourable to the consumer.

36. Jurisdiction

Subject to the consumer carve-out in clause 35, the courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.
